Lumen — Terms and Conditions

The following Terms of Service ("Terms") govern your access to and use of the services offered by Oscillator Michał Dobrzański ("Oscillator Michał Dobrzański," "we," "us," "our"), including the Lumen mobile application (the "App"), the marketing website, email notifications, and any related services (collectively the "Services"). These Terms also cover your use of any information, text, audio, or other materials provided through the Services (the "Content"). Please review these Terms carefully before using the Services.

A. Agreement to Terms

These Terms form a binding legal agreement between you and Oscillator Michał Dobrzański. Your use of the Services, including installing or downloading the App, signifies that you (a) consent to these Terms, (b) have the authority and capacity to enter into them, and (c) own or control the device used to access the Services. These Terms also apply to any updates or supplements we provide that are not covered by a separate license. If you do not agree, do not install or use the App.

We may modify these Terms from time to time. We will notify you of material changes through an in-app message or a notice on the website. Continued use of the Services after a change indicates acceptance. If you disagree with the change, you must stop using the Services.

Your use of the Services is also governed by our Privacy Policy, incorporated by reference. Additional payment terms imposed by Apple or Google apply where you obtained the App through their stores.

Notice to consumers: The law of the country where you reside may give you rights that supplement these Terms; if any clause of these Terms is unenforceable in your jurisdiction, the remaining clauses remain in force.

B. Age eligibility

You must be at least 16 years old to install or use Lumen (or 13 where local law lowers the digital-consent threshold). By accepting these Terms you confirm that you meet this requirement and have the legal capacity to enter into a binding contract in your jurisdiction.

C. License grant

Subject to your compliance with these Terms, Oscillator Michał Dobrzański grants you a limited, personal, non-exclusive, non-transferable, non-sub-licensable, revocable license to install and use the latest generally available version of the App on devices you own or control, for your own legal, personal, non-commercial devotional life. All rights not expressly granted are reserved.

D. Additional rights and restrictions

1. Usage limitations

You may not rent, sell, lease, sublicense, distribute, assign, or transfer any rights to the Services, nor use the Services for any third party's benefit. Without our written permission you may not make the App available over a network for download or use by multiple individuals. You may not employ robots, scrapers, or any automated process to disrupt the Services or to extract content or the underlying models, prompts, or proprietary infrastructure. You may not modify, reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code or create derivative works. You may not circumvent the per-tier generation cap (including by creating multiple accounts on the same device or paying instrument). All improvements to the Services remain our property.

2. Modifications and updates

We may modify or alter features or functions of the Services. When installed, the App routinely communicates with our servers. We may require you to update to a new version of the App as a condition of continued use, and may require you to review and accept updated Terms. Our duty to support older versions ends when an update is released. We are not obliged to provide any future update, supplement, or new version.

3. Access requirements

You are responsible for providing, at your own cost, the equipment, internet connection, device, and service plan needed to access the App. Mobile-data charges from your carrier may apply. The App may not be available on every device, network, or in every country.

E. The Service — what Lumen is and is not

Lumen is a personal devotional companion. You submit a short prompt; the App shapes that prompt into a prayer text using an artificial-intelligence language model, then converts the text to streaming audio. The output is generated content created automatically. It is not:

You are responsible for how you use the output. If a generated prayer does not sit right with you, skip it, regenerate it, or delete it.

F. Your prompts and the generated prayers

1. Ownership

You retain ownership of the prompts you submit. You grant us a non-exclusive, royalty-free, worldwide licence to process those prompts strictly to provide the Service to you — i.e. to forward them to our language-model and text-to-speech sub-processors, generate the output, and store the resulting prayer in your library. The licence ends when you delete the prompt or delete your account. We do not use your prompts to train AI models.

2. Privacy of prompts

Prompts and generated prayers are private to you. Lumen does not expose them to other users; there are no public profiles, feeds, or sharing-by-default. If you choose to share a prayer outside the App (e.g. by copy-paste or screenshot), that is your decision and your responsibility.

3. Prohibited content

You may not submit prompts that:

  1. are illegal under the laws of the Republic of Poland, the European Union, or your country of residence;
  2. infringe a third party's intellectual-property rights;
  3. defame, harass, or invade the privacy of another identifiable person who has not consented;
  4. seek to extract, mirror, or scrape the underlying model;
  5. contain malware, viruses, or attempts at prompt-injection against our infrastructure;
  6. request content the model is contractually restricted from producing.

We may refuse, stop, or remove generations that violate these rules. Repeat or material breach may result in suspension or termination of access without prior notice.

4. Generated-content disclaimer

The prayers are produced by an artificial-intelligence language model under contractual restriction from a third-party provider (Anthropic). The output is shaped to reflect the Catholic tradition but may occasionally contain mistakes, theological inaccuracies, awkward phrasing, or content that does not match your situation. We do not warrant that any generated prayer is doctrinally correct or pastorally appropriate. If something genuinely concerning appears in the output, email lumen.prayer.app@gmail.com so we can investigate.

G. Crisis-safety treatment

If your prompt contains language indicating thoughts of suicide or self-harm, the App will not produce a prayer. Instead it surfaces the phone numbers of crisis hotlines for your region (e.g. 988 in the United States, 116 123 in the United Kingdom and Ireland). You acknowledge that the Service is not a substitute for emergency services and that we cannot intervene on your behalf. If you or someone you know is in immediate danger, contact local emergency services (112 in the EU, 911 in the US) or one of the hotlines surfaced by the App.

H. Account registration and credentials

The App creates an anonymous account on first launch so your library survives a reinstall on the same device. You may optionally link the account to your Apple ID or Google account for cross-device sync. You are responsible for safeguarding the credentials of any linked identity. You must notify us promptly of any unauthorized access. If we reasonably believe your account is compromised, we may suspend or terminate it. We are not liable for losses caused by the misuse of your linked sign-in credentials.

I. Subscriptions, free trial, billing, refunds

1. Tiers

Prices may be displayed in your local currency converted by Apple or Google. Local taxes (VAT in the EU) are included where required. We may change subscription prices for future billing periods; you will be notified in-app and through the App Store / Play Store before the change takes effect, and you may cancel before it does.

2. Payment processing

All purchases are processed by Apple (App Store) or Google (Google Play). We do not store payment card details; we receive only the subscription state from RevenueCat.

3. Free trial

If a free trial is offered, it converts automatically to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends. To cancel: iPhone — Settings → [your name] → Subscriptions; Android — Play Store → Subscriptions; manage through the platform that initiated the subscription.

4. EU consumer right of withdrawal

Under Directive 2011/83/EU on consumer rights and Articles 27–38 of the Polish Consumer Rights Act of 30 May 2014 ("Ustawa o prawach konsumenta"), you normally have 14 days to withdraw from a distance contract. By starting to use Lumen (in particular by generating your first prayer during the trial), you expressly request that supply of the digital service begin before the withdrawal period expires and acknowledge that, in doing so, you lose your right of withdrawal under Article 38(13) of the Polish Consumer Rights Act / Article 16(m) of Directive 2011/83/EU. If you do not generate a prayer during the trial, the right of withdrawal is preserved for the full 14 days.

5. Refunds

Once a billing period starts, refunds are at the discretion of Apple or Google under their respective policies, not ours. To request a refund: App Store users contact Apple Support; Play Store users contact Google Play Support. We will cooperate with refund requests routed to us through Apple or Google.

J. Auto-renewal and recurring fees

Paid subscriptions auto-renew. Once you complete registration and provide your payment details — or at the end of a free trial that you have not cancelled at least 24 hours in advance — you will be billed for the next subscription period. You hereby authorise ongoing, periodic billing at the then-current subscription rate plus any applicable taxes, until you cancel through the platform's subscription settings. Cancellation takes effect at the end of the current billing period.

K. Uninstallation

The procedure for uninstalling the App depends on your device. Uninstalling the App does NOT cancel your paid subscription. You must cancel through the Apple App Store or Google Play subscription settings as described in Sections I and J.

L. Consent for diagnostic data and reviews

You consent to our collection of pseudonymised technical data — device model, OS version, app version, crash reports, lifecycle event names — for the purposes set out in our Privacy Policy. You can opt out under Settings → Privacy.

If you publicly post a review on an App Store or social channel, your review and your public-facing username may become publicly accessible. If you do not want your review used in promotional material, write to lumen.prayer.app@gmail.com.

M. Intellectual property

The Services — including all design, text, illustrations, audio clips, code, content, protocols, software, and documentation we provide — are owned by Oscillator Michał Dobrzański or its licensors and are protected by Polish and international copyright, trademark, patent, and other intellectual-property laws. You may not delete or alter any copyright, trademark, or proprietary-rights notice. All rights not expressly granted are reserved.

The "Lumen" name, the blackletter wordmark, the logo, and the user-interface design are our exclusive property. Third-party fonts (Lora, Inter, UnifrakturMaguntia) are used under the SIL Open Font License 1.1.

Please include: (a) a signature (electronic or physical) of the authorised representative of the copyright owner; (b) identification of the work claimed to be infringed; (c) the location of the infringing material in the App; (d) your contact details; (e) a good-faith statement that the use is not authorised; and (f) a statement that the information in your notice is accurate.

N. Service termination

Your rights under these Terms terminate automatically, without prior notice, if you breach them. We may suspend, modify, or discontinue all or part of the Services at any time. On termination you must cease all use and delete any copies in your control. Sections L through T of these Terms survive termination.

O. Warranty disclaimer

To the maximum extent permitted by law, the Services are provided "AS IS," "WITH ALL FAULTS," and "AS AVAILABLE," and you use them entirely at your own risk. We disclaim all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet your requirements, be uninterrupted, timely, secure, or error-free, or that any generated prayer will be doctrinally correct or pastorally appropriate.

Some jurisdictions do not allow the disclaimer of implied warranties; the disclaimers in this section apply only to the extent permitted by your jurisdiction.

P. Limitation of liability

To the maximum extent permitted by applicable law, Oscillator Michał Dobrzański will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, goodwill, use, data, or other intangibles — even if advised of the possibility of such damages, arising out of or related to:

  1. your use of or inability to use the Services;
  2. unauthorized access to or alteration of your data;
  3. statements or conduct of any third party in connection with the Services; or
  4. any other matter relating to the Services.

Our aggregate liability arising out of or related to these Terms or your use of the Services — whether in contract, tort, statute, or otherwise — will not exceed the greater of (a) the subscription fees you actually paid us in the twelve (12) months preceding the event giving rise to the claim, and (b) EUR 100.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence, or for wilful misconduct. EU consumers retain all statutory rights that cannot be waived by contract under the Polish Civil Code and the Polish Consumer Rights Act.

Q. Indemnification

You agree to indemnify and hold harmless Oscillator Michał Dobrzański, its affiliates, and their officers, directors, employees, and agents from any third-party claim arising out of (a) your breach of these Terms; (b) your violation of any law or third-party right; or (c) prompts you submit that violate Section F.3. This indemnity does not apply to claims caused by our own gross negligence or wilful misconduct.

R. Export-control compliance

The Services and the technology underlying them are subject to Polish, EU, and international export-control laws. You agree to comply with all such laws when downloading or using the App.

S. Availability in different jurisdictions

We do not claim or guarantee that the Services are suitable or available for use in any particular location. We may restrict availability of all or part of the Services to certain individuals, regions, or jurisdictions in our discretion.

T. Governing law and disputes

These Terms are governed by the laws of the Republic of Poland, without regard to its conflict-of-laws principles. The courts of competent jurisdiction for the seat of the operator have non-exclusive jurisdiction over any dispute, subject to the mandatory consumer-protection rules of your country of habitual residence in the EU/EEA.

EU Online Dispute Resolution. The European Commission provides an online dispute-resolution platform at ec.europa.eu/consumers/odr. We are not currently obliged to participate in alternative dispute-resolution proceedings before a consumer arbitration board for EU/EEA members.

YOU AGREE THAT ANY LEGAL ACTION OR PROCEEDING ARISING FROM OR RELATED TO THE SERVICES MUST BE INITIATED WITHIN THREE (3) YEARS AFTER THE RELEVANT CAUSE OF ACTION OCCURS. FAILURE TO DO SO WITHIN THAT TIMEFRAME WILL RESULT IN THE ACTION BEING PERMANENTLY BARRED.

U. Apple- and Google-specific terms

If you obtained the App from the Apple App Store:

  1. These Terms are between you and Oscillator Michał Dobrzański only; Apple is not a party.
  2. The licence granted to you is limited to a personal, non-exclusive, non-transferable right to install the App on Apple-branded devices you own or control, subject to the Usage Rules in Apple's App Store Terms of Service.
  3. Apple has no obligation to provide maintenance or support for the App.
  4. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation.
  5. Apple is not responsible for addressing claims by you or a third party relating to the App, including product-liability, conformity, or consumer-protection claims.
  6. If a third party claims that the App or your use infringes their intellectual-property rights, we (not Apple) are responsible.
  7. You represent and warrant that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting," and that you are not on any US Government list of prohibited or restricted entities.
  8. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Equivalent provisions apply where you obtained the App from Google Play. Google and its affiliates are third-party beneficiaries of these Terms.
